Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Tradium website, applications, and services (collectively, the “Service”) operated by Tradium Labs (“we”, “us”, or “our”). By using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. About the Service
Tradium is a private backtest trade journal that lets users log simulated or historical trades, organize them into strategies and sessions, and review analytics such as win rate, expectancy, and equity curves. The Service is provided for informational and record-keeping purposes only. Tradium is not a broker, exchange, investment adviser, or financial planner. Nothing in the Service constitutes investment advice, trading recommendations, or an offer to buy or sell any security.
2. Eligibility and Accounts
You must be at least 18 years old and capable of forming a binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at agmonchan@gmail.com if you suspect unauthorized access.
3. Acceptable Use
You agree not to:
- use the Service for any illegal purpose or in violation of applicable laws;
- attempt to gain unauthorized access to the Service, other users' accounts, or our systems;
- upload malware, viruses, or any code intended to disrupt the Service;
- scrape, crawl, or automate access to the Service in a way that impairs performance;
- share content that infringes intellectual property rights or violates the privacy of others;
- use the Service to store or transmit material that is unlawful, harmful, or abusive.
4. User Content
You retain ownership of any trade notes, strategy descriptions, and other content you create (“User Content”). By default, your User Content is private. If you choose to make a strategy public, you grant us a limited license to display that content to other users within the Service. You represent that you have the right to share any User Content you make public.
5. Subscription and Payments
Tradium may offer free and paid plans. If you purchase a paid subscription, you agree to pay all fees and applicable taxes. Subscription terms, billing cycles, and cancellation policies will be presented at checkout. We may change pricing with reasonable notice; existing subscriptions are typically honored until the end of the current billing period.
6. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or if continued provision of the Service creates legal or operational risk. You may delete your account at any time from your account settings.
7. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any analytics or results are accurate for your trading decisions. Past performance of any strategy, whether recorded in Tradium or otherwise, does not guarantee future results.
8. Limitation of Liability
To the maximum extent permitted by law, Tradium Labs and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid us for the Service in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Tradium Labs from any claims, damages, or expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of Thailand, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall first be addressed through good-faith negotiation. If unresolved, the dispute shall be resolved in the courts of Thailand.
11. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms on this page with a new effective date. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.
